User Agreement

Our goal is to make Crosspromo.com the most trusted Cross promotions directory and ecommerce site for our users. To do this, we need your help, so any suggestions for improvement can be sent to us directly via the customer survey form. Crosspromo reserves the right to modify these terms of use at any time. We will prominently post these changes prior to implementing them. If you use our website after we post these changes, this indicates your acceptance of them. Regardless of later updates, we will follow the privacy practices described in this privacy statement at the time you provided us with your information. This cross promotions agreement is between the advertiser/advertiser agent and Crosspromo Inc. It is against the rules of this site to use language in ads that discriminates on the basis of classes protected by law, including but not limited to: race or color, national origin, religion, sex, mental or physical handicap, familial status (families with children), pregnancy, veteran's status, sexual

You must be legally able to sell the item(s) you list for sale on the Site. If you are working on behalf of a company or companies to sell items this must be clearly stated on your item description section. You must describe your item and all terms of sale on the listing page of the Site. Your listings may only include video infomercial, text descriptions, graphics, pictures and other content relevant to the sale of that item. All listed items must be listed in an appropriate category. All items in multiple item listings must be identical.

Freebie Redemption: The purchasers of goods and services on Crosspromo.com are entitled to the item or service purchased and the freebie that was allocated to that purchase. Provided the purchaser redeems the freebie before the expiration date noted on the proof of purchase receipt, the Advertiser is obligated to live up to their end of the deal by releasing goods or services paid for or freebies earned on the Crosspromo website. The redemption process must be handled in a timely manner. Buyers must not be harassed to buy into any up sell opportunities upon redemption of goods or services. Falsely representation of goods or services will not be tolerated. Each item advertised must be a true representation of the actual offering. The freebie receipt must not be used as part payment for goods & services except otherwise stated on the product description page.

Content. Crosspromo contains stuff from us, you, and other users. You agree not to copy, modify, or distribute our copyrights or trademarks without express written permission from Crosspromo Inc. Crosspromo Inc. regularly combs through the site and removes listings with inappropriate video content & listings that have no videos attached. The "flag" link underneath every video is a way for the general public to report bad videos. When you give us content, you are granting us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content. (We need these rights to host and display your content.) If you believe that your rights have been violated, please notify our designated copyright agent at Crosspromo customer care and we will investigate the matter. We reserve the right to remove content where we have grounds for suspecting the violation of these terms or of any party's rights. Because we are a venue, in the event that you have a dispute with one or more users, you release Crosspromo (and our parent and its subsidiaries and joint ventures and all such person's, officers, directors, agents and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. We do not control the information provided by other users which is made available through the Site. You may find other user's information to be offensive, harmful, inaccurate, or deceptive. Please use caution, common sense, and practice safe trading when using the Site. Please note that there are also risks of dealing with underage persons or people acting under false pretence. By using this Site, you agree to accept such risks and Crosspromo is not responsible for the acts or omissions of its users. Subject to terms hereof, Advertiser confirms that it has appointed Crosspromo to be its authorized advertiser with respect to all matters relating to this cross promotions agreement and with the understanding that Crosspromo will be paid a commission equal to ten percent (15%) of the value of ANYTHING (goods or services) sold through the Crosspromo websites, this includes all delivery charges that may apply. Crosspromo shall have the right to replace cross promotions campaigns from time to time without notice during the period of this agreement.

Right to advertise: Every seller on Crosspromo.com has the right to advertise their Company or Companies without fear of punishment. Each seller can opt in or opt out of the Crosspromo advertising network as often as they see fit, however opting out of the Crosspromo campaign in any given month, does not exempt a network member from the monthly Crosspromo membership fee. In order to avoid this monthly fee, a network member must completely remove their business listing profile from Crosspromo.com by deleting their user profile. Please note that once an account is deleted, all profile details pertaining to that business will be lost and a new application will be necessary should a business decide to re-instate their membership. A listing fee may be required in order to be re-listed. Each seller can control their advertising campaign on a month by month basis from the vendor profile page. Crosspromo.com has the right to promote every paid in full member registered (for the year in full) on the site through a series of advertising channels including but not exclusive to online advertising. Every ad technique employed will be carried out tastefully with the sole purpose of accurately & respectfully representing each company's identity. Neither buyers nor sellers may manipulate the price of any item nor may any Crosspromo user interfere with other user's listings or transactions.

Fees and Services. Finding listings on Crosspromo is completely free. Businesses wishing to launch their infomercials or commercials with special offers can do so.  A video production fee will apply if Crosspromo is required to produce, film, edit or upload content onto the site. Crosspromo charges a fee for every sale made on Crosspromo.com equal to 10% of the selling price. Our fees are quoted in Canadian Dollars, and we may change them from time to time. Our fees are non-refundable, and Crosspromo deducts its commissions through a pre-authorized payment system as agreed upon by both the vendor and Crosspromo Inc.

Posting a video listing: You will post in the appropriate category or area and will not do any of the following bad things: (a) be false, inaccurate or misleading; (b) be fraudulent or involve the sale of counterfeit or stolen items; (c) infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; (d) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, antidiscrimination or false advertising); (e) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (f) be obscene or contain child pornography (g) contain any viruses, Trojan horses, worms, time bombs, cancel bots, Easter eggs or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information; (h) create liability for us or cause us to lose (in whole or in part) the services of our ISPs or other suppliers; and (i) link directly or indirectly to or include descriptions of goods or services that: (aa) are prohibited under this Agreement; (bb) are concurrently listed for sale on a web site other than Crosspromo (this does not prevent linking to or advertising an Crosspromo item from another web site); or (cc) you do not have a right to link to or include. Furthermore, you may not list any item on the Site (or consummate any transaction that was initiated using our service) that, by paying to us the fifteen percent (15%) sales commission fee, could cause us to violate any applicable law, statute, ordinance or regulation.

General. These terms and the other policies posted on Crosspromo constitute the entire agreement between Crosspromo Incorporated and you, superseding any prior agreements. This agreement is governed by the laws of Canada. If we don't enforce any particular provision, we are not waiving our right to do so later. If a court strikes down any of these terms, the remaining terms will survive. We may automatically assign this agreement in our sole discretion in accordance with the notice provision below. We will send notices to you via the email address you provide, or by registered mail. Notices sent by registered mail will be deemed received five days following the date of mailing. We may update this agreement at any time, with updates taking effect when you next post or after 30 days, whichever is sooner.
